Frequently Asked Questions

1. Why do I need an immigration lawyer?

Australian Migration Law is very complex and often changing area of legislation. Various requirements and rules are introduced or amended on an ongoing basis. It is important for you to be aware of these changes as failure to do so may result in an undesirable outcome. Our lawyers are able to advise you on which visa option is best suited for you based on the current legal requirements and your circumstances.

We will prepare your application for you and ensure presentation of appropriate documents and information to the Department to minimize the chances of your visa being rejected. We will also monitor the progress of your application by liaising with the Department or Tribunal or Court depending on your matter.

Our firm is staffed by lawyers whom have experience and background in interpretation and analysis of the current legal requirements in Migration Law. Also, only lawyers will be able to properly represent you in the Migration Tribunal or Court of law, if it is required.

2. Is it possible to renew my visa?

If you are already in Australia and there is a “No Further Stay” condition attached to your visa, you would need to leave Australia. However if there is no such condition, you will be able to submit a new application to the Department of Immigration. There is however no such thing as “renewing” your visa. Thus you should seek advice on your options well before your current visa expires.

3. How do I make an appointment?

There are (2) two different ways of doing so. You could either call the office directly at + 61 3 9694 4406. Alternatively, you can email us at info@visatec.com.au outlining your preferred day and time to which our lawyer will contact you to confirm the appointment.

4. Initial / First Consultations - How much does it cost?

There is a modest AUD$ 121 charge for our first consultation. During the consultation, an in-depth analysis and options review will be undertaken by our principal migration lawyer. During this consultation, you will also be able to have any of your questions about your situation discussed in confidence and addressed. It will last between 40-60 minutes depending on the complexity of your case. This $121 fee will be deductible should you decide to engage us for your matter. Download a PDF with more details of our fee structure.

5. What if my application has already been refused by the Immigration Department?

Under certain circumstances, you can apply for your application to be reviewed by the relevant Tribunal (Migration Review Tribunal (MRT), or Administrative Appeals Tribunal (AAT).
The review process allows you to submit new and compelling evidence for your matter. The Tribunal may either affirm the Department’s decision refusing to grant the visa OR remit the decision with a direction to the Immigration Department that you have met the requirements for the visa to be granted.

6. Can Visatec guarantee a successful application?

We do not offer guarantees to our clients. However we can assure our clients that we will work hard and extensively on your case using our considerable experience and training to maximise the chances of obtaining a desirable result.

This will only be done after a thorough review is done on your situation.  We will be honest with your chances of success for a particular visa or matter. If it is felt that you should/could apply for alternative visa, we will advise you to do so.

Visatec has an enviable success rate with cases handled for their clients. Our success is achieved through our professional experience, dedication and assurance of hard work and diligence on your matter.  See our Testimonials.

7. If I intend to engage Visatec, what are the following steps?

If you intend on engaging us for your immigration matter, you will need to have discussed your case with us first and Visatec needs to agree to represent you.

Then, we will open a case file for you. In most cases, a deposit usually $500 will be need to be paid into our client account to get your case started. Details of balance payable and any payment arrangement will be discussed and included in your Contract.

We will then handle your immigration matter. We do not limit you to the number of times you can see us in the office. We will arrange for as many meetings as necessary to ensure that your case is up to mark before we submit it to either the Department of Immigration or relevant Tribunal.

8. Can I engage Visatec if I am not in Australia?
